The Criminal Code should be amended in order to provide clear definition of what constitutes “incitement of national, racial, religious or interregional enmity”, limiting prosecution only to cases that incite discrimination, hostility or violence, as defined in the ICCPR. Limits for damages asserted in defamation and libel cases should be introduced, taking into consideration only actual harm proven by the plaintiff.

The legal framework should be reviewed to address identified shortcomings through an inclusive and consultative process and in a timely manner. In particular, the law should be amended to include clear prohibitions and effective sanctions against the misuse of public resources. Consideration should be given to making vote-buying a criminal offence that is a matter of public prosecution. Public sector employees should be shielded from pressure and intimidation. Procedures for establishing campaign violations should be clarified and a system of proportionate sanctions developed, with cancellation of a candidate’s registration possible only as an extraordinary measure for the most serious violations.

The authorities should undertake efforts to create equal opportunities for all candidates. In particular, the rules for state officials in relation to the election campaign should be clarified, and penalties be increased for misuse of public resources. Additional efforts are needed to address the issue of vote-buying, both through voter education and prosecutions, in order to enhance confidence in the electoral process. Consideration should be given to make vote-buying a criminal offence that is a matter of public prosecution. A concrete and genuine commitment from political parties to condemn vote-buying practices could be made.
