Consideration should be given to ensuring the independence of the NTRBC during the whole duration of its mandate and to ensuring that any possible conflicts of interest of individual NTRBC members during the pre-election period are avoided. Furthermore, consideration should be given to enhancing the capacity of the regulatory body to oversee and fully ensure the broadcast media’s compliance with the legislation, as well as to address media-related complaints and impose effective sanctions for possible violations during the election campaign. Decisions of the independent regulatory body should be taken in a timely manner and made public.

The independence of the NCTRB should be guaranteed. Legislation governing the NCTRB should be amended to strengthen sanctions for violations of media-related provisions and prescribe short timeframes for it to react to violations. The oversight body should be proactive and duly exercise its mandate to ensure the broadcast media’s compliance with existing legislation, including during elections. It should enforce the law in a timely manner, including on unmarked promotional campaign materials within news editions and publish its decisions.

The sanctioning tools of the NTRBC for violations of media-related provisions during election campaigns should be further expanded and reinforced by the law. The NTRBC should react to violations in a timely manner to ensure that broadcast media comply with existing legislation. The mechanism for appointment to the NTRBC should include additional professional criteria, such as a competition or assessment, to support its political independence.
