To fully guarantee freedom of association, bans on political parties should be reviewed as should the wide discretionary powers of authorities to deny registration or deregister political parties on unclear and subjective criteria. Any restrictions on fundamental freedoms should have the character of exception, are imposed only when necessary in a democratic society, are proportionate with a legitimate aim, and are not applied in an arbitrary and overly restrictive manner.

The reform of the electoral legal framework should be continued in an open and inclusive manner to address outstanding ODIHR recommendations. Consideration should be given to reviewing the Election Code to eliminate regulatory fragmentation and to address remaining gaps, errors, and conflicting and ambiguous formulations. The NTRBC should be granted an inclusive remit and effective sanctioning powers, enabling it as the regulatory body to take timely and effective measures to enforce media compliance with legally binding provisions. The election law should define a clear system of sanctions related to violations of its media-related provisions and indicate the competent body to address them. Furthermore, consideration should be given to reinforce the NTRBC as an independent regulatory body and to increase its capacity to oversee and fully ensure the broadcast media’s compliance with the legislation, as well as address media-related complaints and impose sanctions for possible violations during the election campaign. Decisions of the independent regulatory body should be taken in a timely manner and made public.
