The election law should be amended to address the gaps and ambiguities identified in this report as well as other recommendations of the OSCE/ODIHR and the Venice Commission. Consideration should be given to undertaking a comprehensive electoral reform with the aim to harmonize election legislation regulating all types of elections. In order to ensure stability in the election legislation and further harmonization, efforts should be made to finalize electoral reform well in advance of next elections and to build in safeguards against changing legislation prior to an election. Consideration could also be given to further delegating regulatory authority to the CEC so that, as the principal body responsible for the implementation of the election law, it has the flexibility to promptly react to any changes in the political-security environment in order to ensure uniformity in how emergency situations are addressed.

Consideration should be given to undertaking a comprehensive electoral reform, which should harmonize election legislation regulating all types of elections and address other pending long-standing recommendations of the OSCE/ODIHR and the Venice Commission. The reform, inter alia, should eliminate undue restrictions on candidacy rights, as well as restrictions on the freedom of mandate. Restrictions on electoral blocs could be lifted in order to promote the competitiveness of the electoral process and wider representation in parliament. Electoral reform needs to be undertaken well in advance of the next elections, and the process should be transparent and inclusive.

As previously recommended, serious consideration should be given to adopting a unified election code. In line with international good practice, it should be adopted in an open and inclusive manner, and any changes to fundamental aspects of the election system should not take effect less than one year prior to an election. The CEC should adopt all necessary regulations to supplement the legislation.

The authorities and law enforcement agencies should take steps to ensure that all cases of violence and intimidation against election stakeholders are investigated promptly in an independent and impartial manner and perpetrators are brought to justice in accordance with the law. Efforts should be stepped up to ensure that all contestants are able to reach out to the electorate on an equal basis and without fear of violence or retribution.
